These Terms of Service ('Terms') govern your access to and use of the Guided Avenue mobile application ('Guided,' the 'App'), the website www.guidedavenue.com (the 'Site'), and any related services (collectively, the 'Services') operated by Guided Avenue Inc. ('Guided Avenue,' 'we,' 'us,' or 'our').
By accessing or using the Services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please discontinue use of the Services immediately. Your continued use of the Services constitutes acceptance of these Terms.
1. Acceptance of Terms
1.1 These Terms apply to all users of the Services, including individuals who use the App for personal journaling, wellness tracking, and other features.
1.2 Guided is intended for users aged 18 or older. Users aged 13-17 may use the Services only with parental or legal guardian consent. By using the app, you confirm that you meet these requirements.
2. Guided Avenue Service
2.1 These Terms apply to all users of the Guided Avenue Service.
2.2 Guided Avenue grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes, provided you adhere to these Terms. Users agree:
(i) You will not duplicate, copy, distribute, sell, or transfer any part of the Service without prior written consent.
(ii) You will not attempt to modify, hack, reverse-engineer, or interfere with any part of the Service.
(iii) You will comply with all applicable laws and regulations when using the Service.
2.3 Guided Avenue may occasionally pause access to the Services for maintenance, updates, or security reasons. We will strive to minimize disruptions but do not guarantee 24/7 availability.
2.4 The Services may contain third-party links that are not owned or controlled by Guided Avenue. We assume no responsibility for third-party content, websites, or services. By using the Service, you acknowledge that Guided Avenue is not liable for any damages, claims, or losses arising from your use of third-party services.
2.5 If you are under 18 (between 13-17), your parent or legal guardian must review and agree to these Terms of Service before you create an account. If we discover that a minor under 18 has used the Services without proper consent, we reserve the right to suspend or delete the account. Parents and guardians of users under 18 are responsible for monitoring their use of the app and ensuring that the content and journaling features align with their child's needs.
Guided does not knowingly collect or store personal information from children under the age of 13. If we learn that we have collected personal data from a child under 13, we will take immediate steps to delete the data. If you believe we may have unintentionally collected information from a minor under 13, please contact us at hello@guidedavenue.com.
2.6 By creating an account or accessing any part of the Services, you acknowledge that you have read, understood, and agreed to abide by these Terms, as well as our Privacy Policy, which is incorporated by reference.
3. Description of Services
3.1 Guided is a digital journaling and wellness platform designed to help users explore their thoughts, emotions, and personal growth through journaling prompts, mood tracking, guided exercises, and other self-reflection tools.
3.2 Guided Avenue offers premium features and is a paid subscription-based platform with access to certain advanced functionalities, such as AI-driven journaling insights, personalized prompts, and in-depth analytics.
3.3 The Services may also include community-driven features, such as discussion spaces, coaching resources, or challenges. Guided Avenue is not a replacement for professional mental health care and should not be used as a substitute for therapy, counseling, or medical treatment.
4. Account Registration & Security
4.1 To access certain features of the App, you may be required to create an account by providing accurate and complete information.
4.2 You are responsible for maintaining the confidentiality of your account credentials. If you believe your account has been compromised, you must notify us immediately at hello@guidedavenue.com.
4.3 Guided Avenue reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, harmful, or abusive behavior.
5. Fees, Subscriptions, and Payments
5.1 Guided Avenue may offer subscription plans, one-time purchases, and premium content within the App and on the Site.
5.2 By subscribing to a paid plan, you agree to be billed on a recurring basis (weekly, monthly, or annually) until you cancel. Payments are processed through third-party payment processors (such as Apple App Store, Google Play, or Stripe).
5.3 You may cancel your subscription at any time through your respective third-party payment processors. Cancellations take effect at the end of the current billing cycle. No refunds will be issued for partially used subscription periods.
5.4 It is the user's responsibility to review and comply with the respective third-party payment processors' policies regarding cancellations, refunds, and billing practices. Guided Avenue is not responsible for any decisions or actions taken by these third-party platforms, and we encourage users to familiarize themselves with their terms and conditions.
5.5 Guided Avenue reserves the right to modify pricing at any time. We will notify you of any pricing changes at least 30 days in advance via email or through in-app notifications. You will have the option to cancel your subscription before the new pricing takes effect.
6. Privacy & Data Security
6.1 Your privacy is important to us. We collect and process your data in accordance with our Privacy Policy.
6.2 Guided Avenue complies with applicable international data protection laws, such as GDPR and CCPA, ensuring user privacy and limited third-party data sharing.
6.3 Guided Avenue does not sell, rent, or trade your personal data. However, certain third-party services (such as payment processors and analytics tools) may require limited data sharing to operate the Services effectively.
6.4 While we implement reasonable security measures to protect user data, no method of digital transmission or storage is 100% secure. By using the Services, you acknowledge that you share data at your own risk.
6.4 Users may request account deletion at any time through the app's account settings or by contacting us via email at hello@guidedavenue.com. Upon account deletion, all user-submitted content will be removed in accordance with industry best practices. However, please note that residual copies may remain in backups or archives for a limited time, solely for compliance with legal or operational requirements.
7. User Content & Intellectual Property
7.1 The Services allow users to create and store personal journal entries, notes, and other content ('User Content'). You retain ownership of your content.
7.2 By using the App, you grant Guided Avenue a limited, non-exclusive, royalty-free license to store, process, and display your content solely for the purpose of operating and improving the Services.
7.3 You may not use the Services to submit, share, or store any content that:
(i) Violates any copyright, trademark, or intellectual property rights
(ii) Contains hateful, discriminatory, obscene, or illegal material
(iii) Promotes fraud, scams, or deceptive practices
(iv) Contains harmful software (malware, viruses, etc.)
7.4 Guided Avenue reserves the right to remove or restrict any User Content that violates these Terms.
8. Disclaimers & Limitations of Liability
8.1 Guided Avenue provides self-reflection tools, journaling features, and wellness resources designed to support personal growth. However, we do not offer medical, psychological, or professional health advice. The use of our App and Services should not be considered a substitute for professional therapy, counseling, or medical treatment. If you are experiencing mental health challenges, we strongly encourage you to seek support from a qualified professional.
8.2 While Guided Avenue is designed to help users cultivate self-awareness, emotional well-being, and personal growth, we do not guarantee specific results. Your progress depends on your own efforts, consistency, and individual circumstances. Any insights, reflections, or recommendations provided within the App, including those from our AI companion, should be used at your own discretion. We strive to keep the Services available and functioning correctly, but we do not guarantee that the App will always be uninterrupted, error-free, or free from security risks.
8.3 Guided Avenue includes AI-generated journaling tools for self-reflection, with content intended for informational purposes. Users should exercise their own judgment and seek professional advice when needed.
(i) AI-generated content is not guaranteed to be accurate, reliable, or applicable to every user.
(ii) Users should exercise their own judgment when engaging with AI-powered features.
(iii) Guided Avenue does not assume liability for any decisions, actions, or emotional responses resulting from AI-generated insights.
8.4 You acknowledge that your engagement with Guided Avenue is voluntary and that any decisions or actions you take based on the content within the App and on the Site are solely your responsibility. We are not liable for any direct or indirect outcomes that result from using our services.
8.5 You agree to defend, indemnify, and hold harmless Guided Avenue, its affiliates, employees, officers, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:
(i) Your access to or use of the Services.
(ii) Your violation of these Terms.
(iii) Your infringement of any third-party rights, including intellectual property, privacy, or other proprietary rights.
(iv) Any claim that content you submit through the Services caused harm to a third party.
(v) The loss of journal entries or personal data.
(vi) Downtime, technical issues, or service interruptions.
(vii) Unauthorized access to or misuse of your account.
(viii) Any decisions or actions you take based on insights, prompts, or recommendations provided by the App.
8.6 Guided Avenue reserves the right to assume exclusive defense of any claim for which you must indemnify us. You agree to fully cooperate with our defense strategy.
8.7 Maximum Liability: In no event shall Guided Avenue's total liability exceed the amount paid by you in the last 12 months for the Services.
8.8 These Terms and your use of the Service shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be exclusively submitted to the courts located in Ontario, Canada, and you agree to the jurisdiction of such courts. You waive any objection to such venue on the grounds of lack of personal jurisdiction, inconvenient forum, or any other basis.
